Terms and Conditions
1. DEFINITIONS
A. "We", "us", "our", or "GCT" means Roselyn Dayle and her employees and agents, as the case may be.
B. "Services" means access and use of our online services including www.greenchangingtable.ca, and any mobile application accessible through tablets, smartphones, and other devices that we may utilize from time to time.
C. "Member" means any individual who has or had a registry with us.
D. "Visitor" means any individual who does not register with us but explores our Services.
2. GENERAL TERMS
A. We reserve the right to refuse service to anyone for any reason at any time. You understand that your information may be transferred unencrypted and may involved transmission over independent networks and changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service, or any contact on the Service, without express written consent from us.
B. By agreeing to these Terms and Conditions you represent that you are at least the age of majority in your state or province of residence and that you have given us your consent to allow any of your minor dependents to use the Service. You may not use our products for any illegal or unauthorized purpose nor may you violate any laws in your jurisdiction in your use of the Service. A breach or violation of any of the terms and conditions herein will result in the immediate termination of your Services.
C. Your use of the Services might involve the collection and transmission of personal information and you consent to the collection, use, and distribution of same.
D. You represent that all information provided by you in your use of the Service is accurate, complete, and current. We are not responsible if information made available in the Service is not accurate, complete, or current. The material on the Service is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary sources of information. Any reliance on the material on the Service is at your own risk. The Service may contain certain historical information which is not current and is provided for reference only. We reserve the right to modify the contents of the Service at any time but we have no obligation to update any information on the Service nor expressly notify you when modifications to the Service have been made. You agree that it is your responsibility to monitor changes to the Service.
3. USE OF THE SERVICE
A. You agree that you will comply with all applicable laws in your use of the Service and you will not use the Service for any unlawful purpose.
B. You agree that you will not upload, post, e-mail, transmit, or otherwise make available any content that:
- Infringes any copyright, trademark, right of publicity, or other proprietary rights of any person or entity;
- Is defamatory, libelous, indecent, obscene, pornographic, sexually explicit, invasive of another’s privacy, promotes violence, or contains hate speech; or
- Discloses any sensitive information about another person, including that person’s e-mail address, telephone number, credit card information, or any similar information, without that person’s express consent.
C. You further agree that we have the right, in our sole, unfettered discretion, to delete or remove any information uploaded, posted, e-mailed, transmitted, or otherwise made available by you on the Service, notwithstanding that such information may not be of a nature described by the foregoing clause.
D. You agree that you will not use the Service to engage in commercial activities nor to collect any market research.
4. VISITOR CONTRIBUTIONS
Visitors agree that we make no representation nor warranty in connection with the accuracy, completeness, and truthfulness of any information uploaded to transmitted to the Service from Members and that we shall not be liable for the manner in which any contribution from Visitors are ultimately utilized. Without limiting the generality of the foregoing, this includes that Visitors release us and hold us harmless from any claim for loss or damages in connection with cash contributions to a Member’s RESP product in the event that cash so contributed by a Visitor is not utilized by a Member to fund a portion or all of a represented RESP.
5. NO WARRANTIES
The Service and all content, functions, and materials made available to you through the Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including, without limitation, and warranties of title, non-infringement, merchantability or fitness for a particular purpose, and any warranties arising from a course of dealing, course of performance, or usage of trade.
In connection with any warranty, contract, or common law tort claims, you agree that we shall not be liable for any incidental or consequential damages, lost profits, loss, or damages in any form including, but not limited to, lost data or business interruption resulting from the use or inability to access and use the Service, nor any direct damages that you may suffer as a result of your use of the Service.
6. SEVERABILITY
In the event that any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed to be severed from these Terms and Conditions. Such determination shall not affect the validity and enforceability of any other remaining provisions.
